CRIMINAL LAW

Narcotics law governs the handling of prohibited substances under the German Narcotics Act (BtMG). Since the Cannabis Consumption Act (CanG) came into force, the private possession and cultivation of cannabis has been legalized within strict limits. Trafficking, unauthorized distribution, and possession of quantities exceeding the permitted limits remain criminal offenses. Strict penalties continue to apply to other narcotics such as cocaine and heroin. In many cases, mandatory therapy or measures under Section 35 of the BtMG can offer a mitigating alternative.

JUVENILE CRIMINAL LAW

Juvenile criminal law applies to young people (14–17 years) and, in special cases, also to young adults (18–20 years). It prioritizes education and reintegration over punishment. Instead of imprisonment, the focus is on educational measures such as conditions, community service, or training courses. The aim is to prevent future offenses and positively influence the young person's development.

CAPITAL PENAL LAW

Capital criminal law deals with the most serious crimes, such as murder, manslaughter, robbery resulting in death, or extortionate kidnapping. These offenses are regulated particularly strictly in the criminal code and generally carry long prison sentences, up to and including life imprisonment. Proceedings in capital criminal law are complex, often attract media attention, and require a carefully considered defense strategy.

The aim of the defense is to examine the question of the act and guilt precisely and to fully protect the rights of the accused.

MEDICAL CRIMINAL LAW

Medical criminal law encompasses all criminally relevant issues in the healthcare sector. This includes, among other things, allegations such as medical malpractice, billing fraud, bodily harm, or violations of drug and narcotics laws.

Doctors and medical staff often face complex legal proceedings where medical and legal expertise are closely intertwined. The goal of a defense is to protect their professional reputation and their medical license.

BUSINESS LAW

White-collar crime deals with offenses committed in business and economic life, such as fraud, embezzlement, insolvency offenses, corruption, and tax evasion. Proceedings in this area are often complex and involve extensive files, economic contexts, and special regulations. SEXUAL CRIME LAW

Attorney Raphael Botor has been working at the second law firm in Rosenheim, founded in 1981 by attorney Axel Kampf, since September 2014, and has been running it independently and on his own responsibility since January 1, 2017. The former owner of the firm, however, continues to advise him, drawing on his more than 35 years of experience.


Based on his proven, above-average theoretical and practical knowledge in criminal law and criminal procedure, the Bar Association for the Higher Regional Court District of Munich has granted the lawyer and criminal defense attorney Raphael Botor permission to use the title "Specialist Lawyer for Criminal Law".
Another focus is on supporting foreigners and immigrants in all legal matters – in particular, representation before authorities or courts. This also includes legal representation of foreigners before embassies and consulates, as well as in matters concerning entry and/or residence of foreign nationals and visa procedures.
