Capital punishment is a term that is not recognized in the Criminal Code (StGB) itself.

However, it is commonly used in criminal law to describe all crimes directed against human life. This includes, in particular, intentional homicide offenses such as murder and manslaughter . In cases of murder, it must be noted that these invariably result in life imprisonment. The court can further aggravate this sentence by considering the so-called serious nature of the guilt and by ordering preventive detention, which is becoming increasingly common.

Capital punishment law is not without reason considered one of the most demanding areas of criminal law. This is primarily due to the high cost and complexity of the proceedings involved.

In such proceedings, investigators from the homicide squad and officials from the public prosecutor's office, experts and forensic pathologists are involved, resulting in very extensive files that every defense attorney must be very familiar with.
